El Sr. Presidente Constitucional de la República del Ecuador, en ejercicio de las atribuciones conferidas en el artículo 147, numeral 13, de la Constitución de la República, expide el Decreto Ejecutivo N° 1166, mediante el cual elimina la especie valorada “Certificado de Antecedentes Policiales Personales”, para los trámites administrativos en Instituciones públicas y privadas, en cuyo reemplazo se establece el “CERTIFICADO DE ANTECEDENTES PENALES”, el cual será extendido de manera gratuita por el Ministerio del Interior a través de su portal web.
El “Certificado de Antecedentes Penales” deberá ser solicitado ya sea de manera directa o judicialmente vía internet a través del portal web www.ministeriodelinterior.gob.ec, por parte de las personas naturales y/o jurídicas tales como: oferentes de empleo, prestadores públicos o privados. etc.; debiendo señalar en la misma solicitud los motivos específicos de su requerimiento, e inmediatamente el “Certificado de Antecedentes Penales”, es enviado por el Ministerio del Interior al solicitante por la misma vía.
Queda prohibido tanto para el sector público como privado, exigir a ningún ciudadano o ciudadana la presentación del “CERTIFICADO DE ANTECEDENTES PENALES” como requisito, para quién aspire a un empleo o que realice cualquier trámite en las entidades de cualquiera de los sectores señalados.
En ningún caso, se trasladará la obligación de obtener dicho certificado al postulante del empleo y/o usuario de cualesquier servicio público o privado en sus diferentes trámites.
